Marketing Counsel (Contract) – Food & Beverage
Overview
LHH has partnered with a well-known company who is seeking an experienced Marketing Counsel to support a food & beverage company on advertising, regulatory, and marketing‑related legal matters. The client is only considering long‑term contract attorneys at this time.
The ideal candidate brings strong in‑house experience, excellent credentials, and a proactive working style. This role is IP‑adjacent, but the primary focus is FTC, FDA, and marketing/regulatory compliance rather than pure IP prosecution.
Key Responsibilities
Review and advise on marketing, advertising, and promotional materials for FTC and FDA compliance
Counsel on food and packaging labeling claims, endorsements, influencer/ambassador programs, and social media
Provide legal guidance on truth‑in‑advertising, claim substantiation, and regulatory risk
Review and negotiate marketing‑related agreements, including licenses, sponsorships, endorsements, and promotional agreements
Support brand management initiatives and collaborate cross‑functionally with marketing and business teams
Respond to inquiries from regulatory agencies related to advertising and marketing
Manage outside counsel as needed and provide practical, business‑focused risk assessments
Required Qualifications
J.D. from an accredited law school with strong academic credentials
Admission in good standing to a U.S. state bar (California preferred)
10–12 years of experience in advertising, marketing, regulatory, and IP‑adjacent matters
Mandatory experience with FTC regulations related to advertising, media, and marketing
Mandatory FDA regulatory experience within the food & beverage industry
Prior in‑house legal experience strongly preferred
Proactive, self‑directed work style (ability to identify and take ownership of work without waiting for assignment)
Additional Details
Schedule: Part‑Time (approximately 10–20 hours per week)
Fully remote, but must be comfortable working with teams across time zones
Candidates are asked to commit to at least 6 months; longer engagements are common
Two weeks’ notice requested if a permanent role is secured during the engagement
Location: Fully Remote (must be flexible working with multiple time zones)
Engagement Type: Long‑Term Contract (6‑month commitment requested)
Pay Rate: $100–$115/hour
Benefit offerings include medical, dental, vision, life insurance, short-term disability, additional voluntary benefits, EAP program, commuter benefits, and 401K plan. Available paid leave may include Paid Sick Leave, any other paid leave required by Federal, State, or local law, and Holiday pay upon meeting eligibility criteria.
